Out of State Brokers Must Hold Nonresident Surplus Lines License

REF: NC Surplus Lines Tax Filing for Non- Residents
Effective immediately, when submitting Form F information for NCSLA to do the tax filings for your company, we need a copy of the non-resident NC Surplus Lines license for the licensed individual within your company.
The North Carolina Department of Insurance has had a legal opinion given to them that says that the surplus lines statues of NC require that a nonresident must hold a NC Nonresident Surplus Lines License to place coverage on risks in North Carolina (unless it is written by a NC Resident Surplus Lines Licensee) and the Department is no longer allowing the NCSLA or any resident surplus lines licensee to file taxes for out of state brokers that do not hold a NC Nonresident Surplus Lines License.
If you do not have anyone within your company that holds a non-resident surplus lines license in North Carolina, we will not be able to file your taxes for you. Please contact the agent services division of the NC Department of Insurance at 919- 733- 7487 to apply for your license. I am also attaching a copy of an application for your convenience.
