“For insureds whose home state is this State, no agent or broker licensed by the Commissioner shall procure any contract of surplus lines insurance with any non-admitted insurer, unless he possesses a current surplus lines insurance license issued by the Commissioner" N.C. Gen. Stat § 58-21-65(a).
Every licensed agent or broker (whether classified as an agent, underwriter, broker, account representative or otherwise) employed by a North Carolina wholesale broker who places (procures) a contract of surplus lines insurance on behalf of a retail agent with an eligible non admitted insurer must have a surplus lines license.
A retail agent (resident or non-resident) who places surplus lines business with an eligible non-admitted insurer through a North Carolina surplus lines licensee (resident or non-resident) is not required to have a North Carolina surplus lines license. However, any retail agent (resident or non-resident) who places (procures) any contract of insurance directly with an eligible non-admitted insurer must have a North Carolina surplus lines license.
