Surplus Lines Exam

NORTH CAROLINA GENERAL STATUTE §58-21-65

“For insureds whose home state is this State, no agent or broker licensed by the Commissioner shall procure any contract of surplus lines insurance with any non-admitted insurer, unless he possesses a current surplus lines insurance license issued by the Commissioner" N.C. Gen. Stat § 58-21-65(a).

Every licensed agent or broker (whether classified as an agent, underwriter, broker, account representative or otherwise) employed by a North Carolina wholesale broker who places (procures) a contract of surplus lines insurance on behalf of a retail agent with an eligible non admitted insurer must have a surplus lines license.

A retail agent (resident or non-resident) who places surplus lines business with an eligible non-admitted insurer through a North Carolina surplus lines licensee (resident or non-resident) is not required to have a North Carolina surplus lines license. However, any retail agent (resident or non-resident) who places (procures) any contract of insurance directly with an eligible non-admitted insurer must have a North Carolina surplus lines license.

 

STEPS TO OBTAIN A NORTH CAROLINA SURPLUS LINES LICENSE

Resident Agents:+

  • Must have a current North Carolina property & casualty license.
  • Register to take the North Carolina surplus lines examination.

  • Exam Information
    20% of the questions are general property & casualty questions.
    80% of the questions are taken directly from the North Carolina Surplus Lines Act, N.C. Gen. Stat. § 58-21.
  • Download Study Guide
  • After confirmation of passing the examination, you must join the NCSLA, N.C. Gen. Stat. §58-21-40.

Non-Resident Agents:+

  • Must have a surplus lines license issued by your home state.
  • Non-Resident Registration Form
  • After you receive your North Carolina non-resident surplus lines license, you must join the NCSLA,
    N.C. Gen. Stat. §58-21-40.
